Court rejects Alabama appeal over immigration law

MONTGOMERY, Ala. (AP) ? An attorney for the Montgomery-based Southern Poverty Law Center says he's not surprised the U.S. Supreme Court has turned down a request to revive portions of Alabama's immigration law.

Supreme Court justices on Monday upheld a federal appeals court ruling that blocked parts of the law. SPLC attorney Sam Brooke says lower courts have already said immigration reform is a function of the federal government, not the states.

Brooke says he hopes the ruling will motivate Congress to seek meaningful reform.

Justice Antonin Scalia voted to hear the appeal. A spokeswoman for Attorney General Luther Strange, Joy Patterson, says Scalia's vote is a sign that once additional courts have considered the issue, the Supreme Court will grant review.

"We are disappointed that the Court decided not to consider this case, over Justice Scalia's dissent," Patterson said. "Many other states are facing similar litigation, and the lower court in our case was the first federal court of appeals to consider this particular issue. Other cases raising the issue from other states are likely to appear at the Supreme Court in the future. Hopefully Justice Scalia's vote indicates that once those additional courts have weighed in, the Supreme Court will be willing to grant review."

The case will now go back to the trial court. The parties and the court will have to sort through which issues have now been resolved by the Supreme Court in Arizona and the U.S. Court of Appeals for the 11th Circuit. Some issues will require further litigation, while other issues will not.

"The Supreme Court has rightly struck another nail in the coffin of laws that attempt to sanction racial profiling," said Karen Tumlin, managing attorney for the National Immigration Law Center. "Alabama's legislators, both at the state and at the federal level should take note: they, like the rest of the country, should move forward, not backward, to bring our immigration laws in line with our societal and economic needs."

Cecilia Wang, director of the American Civil Liberty Union's Immigrants' Rights Project, said she feels the Supreme Court made the right decision to hear the case.

"All the lower federal courts ? and the court of public opinion ? have said no to divisive state laws like this one, and Americans have moved on to support immigration reform that creates a new common sense immigration system."

House Majority Leader Micky Hammon (R-Decatur) said in a statement, "This issue is not going away any time soon and I agree with Attorney General Strange that the Supreme Court's actions today are only delaying the inevitable." Hammon noted that most of Alabama's immigration law has been upheld by the courts and said the ruling won't affect law enforcement's ability to enforce it.

"I hope that the Supreme Court will stop kicking the can down the road and weigh in on this issue of utmost importance to not only Alabamians but the country as well," Hammon said.

Closed-shop consenting for oil exploration sub-standard, EDS says

New Zealand will not be able to claim "world class" oil and gas sector regulation if it pushes ahead with a plan that would stop public hearings on resource consents for oil exploration in the country's Exclusive Economic Zone, says the Environmental Defence Society.

The commitment to world class regulation was in conflict with a proposed process which would see applications for exploration with the country's 200 nautical mile EEZ not requiring public notification or submissions, and handled by the "politically appointed" Environmental Protection Authority.

"There would be no opportunity for third parties to be heard by an independent hearings panel, no opportunity to question the applicant on its environmental record or intentions, and no opportunity to call expert evidence on the environmental effects of the exploration activity," said EDS chair Gary Taylor.

His comments come after Energy Minister Simon Bridges unveiled the 2013 block offer for oil and gas exploration, including some 190,000 square kilometres of offshore acreage, much of it in the EEZ.

"Public scrutiny is an essential component of best practice environmental regulation. A closed-shop consenting regime is not transparent and raises the possibility of agency capture and political influence," said Taylor.

"Given the extreme consequences if something goes wrong this is quite unacceptable."

While EDS did not oppose oil and gas exploration, but "we want to see best practice out there to protect our ocean and coastlines."

Spain sinks deeper into recession in first quarter

MADRID (Reuters) - Spain's economy shrank for the seventh straight quarter from January to March, preliminary data showed on Tuesday, and the recession looks set to last into next year.

Acute joblessness and grim economic data from Spain and other euro zone countries have fueled a raging debate over whether Europe should abandon austerity policies that are still favored by regional powerhouse Germany.

Spain's Gross Domestic Product contracted 0.5 percent in the first three months of this year from the last quarter of 2012, according to preliminary data from the National Statistics Institute, dragged lower by sliding domestic demand.

The Spanish government slashed its economic forecasts for this year on Friday, bringing expectations closer to consensus, though did not announce any significant updates to its vital reform plan designed to restart the economy.

"We recognize the reforms of the government have been significant, but the problem is the starting position of the Spanish economy was much worse than any other European economies and adjusting in this environment is a lengthy process," analyst at Nomura Silvio Peruzzo said.

"We don't see Spain returning to growth until some time next year."

The economy shrank 2 percent on an annual basis in the first quarter, worse than the 1.9 percent registered a quarter earlier and the worst annual contraction since the start of the current recession in the last quarter of 2011.

Spain has been in and out of recession since 2008 when a property bubble burst and put millions out of work and gutted consumer and business confidence. The country is still struggling to replace the once-booming construction sector to boost growth.

The euro zone's fourth largest economy has been on the front line of the bloc's debt crisis on concerns over one of the regions highest public deficit, prompting Madrid to pass a slew of austerity measures critics say has hobbled recovery.

The government, meanwhile, says the worst of the slump has passed and sees quarterly growth before the end of this year mostly because the country has become more competitive and exports are growing.

"All the indicators which look forward in Spain point to recovery, and a much better economy than one year ago," Economy Minister Luis de Guindos said in a radio interview on Tuesday.

Updated at 10:07 p.m. ET: LOS ANGELES -- An attorney for the concert promotion company AEG Live warned jurors they would see a very different view of the charismatic Michael Jackson as the company seeks to prove it was not liable for the pop star's death.

Marvin Putnam, making his opening statement in what is expected to be an emotional wrongful death trial, said AEG officials had no idea that Jackson was taking the surgical anesthetic that led to his death.

He said the three-month civil case would bring to light "some ugly stuff" about the singer's private behavior.

"The public Michael Jackson was very different from the private Michael Jackson," Putnam said. "He erected a wall between himself and his family. Even his family wasn't sure what was going on at the house. He kept those who might have been able help him at a distance."

He said Jackson had been using the powerful anesthetic propofol for years to help him sleep "and almost no one knew."

"AEG, like everyone else, was an outsider," Putnam said. "They had no idea. It was going on behind locked doors."

The "Thriller" singer's mother, Katherine, is suing privately held AEG Live, promoters of a never-realized series of comeback concerts by Jackson, for negligence in hiring Dr. Conrad Murray as his personal physician.

Murray, convicted in 2011 for the involuntary manslaughter of Jackson with a propofol overdose, was caring for the singer as he rehearsed in Los Angeles for a series of 50 "This is It" shows in London in 2009.

Brian Panish, representing Jackson's family, said AEG Live ignored red flags when it hired Murray and should have been aware that the singer had addiction problems years before he agreed to perform the concerts.

Jackson, 50, drowning in debt and seeking to rebuild a reputation damaged by his 2005 trial and acquittal on child molestation charges, died in Los Angeles in June 2009.

In his opening argument, Panish said AEG Live failed to do proper background checks on Murray, who asked for $5 million to care for the singer. Background checks would have revealed Murray was in debt and was a cardiologist even though Jackson had no known heart issues, Panish said.

"When a red flag comes up, do you turn away or do you look into it?" Panish said. "AEG ignored the obvious red flags and they hired Dr. Murray."

AEG Live contends that it did not hire or supervise Murray, saying that a proposed contract with him was never executed. The concert promoters also have said they could not have foreseen that Murray posed a danger to Jackson.

"This case is about the choices we make and the personal responsibilities that go with that," Putnam said on Monday.

Katherine Jackson, 82, along with her children Randy and Rebbie, were among family members attending Monday's packed opening of the trial. Jackson's three children, who could be called as witnesses later, were not there.

Panish said Jackson had known problems with prescription drug addiction dating back to use of the painkiller Demerol following a burn injury when he was shooting a Pepsi commercial in 1984.

Jackson in 1993 announced he was canceling a world tour to seek treatment for his painkiller addiction.

In the days before the trial began, Panish denied the Jackson family is seeking $40 billion in damages from AEG Live, as some media had reported this month.

The final amount will be determined by the jury should it hold AEG Live liable for negligence.

A handful of Jackson fans gathered outside the court, saying they were hoping for justice for the "King of Pop."

Jackson fan Julia Thomas, 40, an office worker from Colton, California, said she hoped the trial would demonstrate what she said were the wrongs AEG Live committed against Jackson.

"They're about to be exposed because they bullied Michael, they stressed him into the grave to the point that he needed sedatives to sleep," Thomas told Reuters.

No benefit of evening primrose oil for treating eczema, review suggests

Research into the complementary therapies evening primrose oil and borage oil shows little, if any, benefit for people with eczema compared with placebo, according to a new systematic review. The authors, who published their review in The Cochrane Library, conclude that further studies on the therapies would be difficult to justify.

Atopic eczema, also known as atopic dermatitis, is an itchy skin condition with no known cure. Usually emerging in childhood, it affects about 10 to 20% of school age children, who may suffer with tight, red, painful skin, sleepless nights and low self-esteem due to appearance, itching and scratching. For around 60% of people, the disorder will improve or clear up by adulthood. Creams, ointments, bath additives, topical steroids and antihistamines are some of the treatments prescribed to ease the condition. However, people often turn to complementary therapies such as evening primrose oil and borage oil in the belief that they will avoid side effects of conventional eczema treatments. Both evening primrose oil and borage oil contain high quantities of gamma linoleic acid, which was once thought to play a role in reducing skin inflammation in eczema.

The researchers analysed the benefits and side effects associated with evening primrose oil and borage oil in 27 studies involving a total of 1,596 people (adults and children) in 27 countries. Participants took evening primrose oil or borage oil, or a placebo, for between 3-24 weeks. Overall, the researchers found that taking evening primrose or borage oil offered no clear improvement of eczema symptoms over placebos. Commonly used placebos included olive oil and paraffin oil. There was also no improvement in quality of life with the complementary therapies, although only two studies considered this measure.

"There is no evidence that taking either evening primrose or borage oil is of benefit to eczema sufferers," said lead researcher Joel Bamford of the University of Minnesota Medical School and Essentia Health System in Duluth, Minnesota, US. "Given the strength of the evidence in our review, we think further studies on the use of these complementary therapies to treat eczema would be hard to justify."

Some participants in the studies experienced mild side effects such as headaches and stomach upsets or diarrhea as they also did while taking placebos. However, none of the selected studies evaluated or mentioned bleeding or anti-clotting effects, which have previously been associated with evening primrose oil. "Consumers need to be warned that oral evening primrose oil is listed as a known cause of increased bleeding for those taking Coumadin or warfarin, a very common medication," said Bamford.

The film and its talking head participants paint the picture in both broad strokes and fine detail.

Whatever one's political stripe regarding Israel, it's hard to dispute the impressions and perspective of the film's six eyewitnesses.

The level of candor here may not satisfy hard-liners of either stripe, but it can help viewers begin to formulate new questions about the philosophical, strategic and moral challenges of conflict, in particular "wars on terror."

Ultimately the movie feels evasive, and its flashy, digitally animated re-creations of military surveillance footage unpleasantly evoke the Call of Duty video games.

It offers startlingly honest insight into the Israeli-Palestinian conflict from some of those who called the shots.

As a political testament, the result is revealing and important.

In the end, the accumulated stories in The Gatekeepers offer tremendous insight about the Israeli-Palestinian situation. It feels more like it was prepared as a history document for Shin Bet rookies than a documentary.

LOS ANGELES (AP) - Clayton Kershaw retired 18 consecutive batters and struck out 12 in eight dominant innings, Carl Crawford homered twice against Kyle Lohse and the Los Angeles Dodgers beat the Milwaukee Brewers 2-0 on Sunday.

Kershaw (3-2) scattered four hits and didn't walk a batter while lowering his ERA to 1.73. The 2011 Cy Young Award winner, who led the NL in ERA in each of the previous two seasons, hasn't allowed more than three earned runs in any of his last 18 starts - the longest active streak in the majors. The last time he did was July 24, 2012, when he gave up eight at St. Louis.

Kershaw stranded runners in scoring position in each of the first two innings, retiring Jonathan Lucroy on a double-play grounder in the first and striking out Martin Maldonado to end the second. He gave up a leadoff double in the eighth to Carlos Gomez, who tried to advance on a broken-bat comebacker to Kershaw and was tagged out by third baseman Juan Uribe in a rundown.

Kershaw's string of consecutive outs began after Rickie Weeks' bloop double leading off the second.

Milwaukee's only other hits were one-out singles in the first by Jean Segura and Ryan Braun. It was the left-hander's fifth game with at least 12 strikeouts.

Kershaw began the season with 4-0 and 1-0 wins over San Francisco and Pittsburgh, allowing no runs over 16 innings. On opening day, he threw a complete-game four-hitter

Brandon League pitched a perfect ninth inning for his eighth save in nine chances.

Crawford drove Lohse's first pitch of the game over the center field fence. It was the fourth time that the right-hander gave up a home run to his first batter in 336 career starts - and the first one that came on his very first pitch. Crawford's second homer came on an 0-2 count and landed in the right field pavilion. It was his sixth multihomer game in the majors and first since July 8, 2010, for the Tampa Bay Rays against Cleveland's Jake Westbrook.

Lohse (1-2) gave up five hits and no walks while striking out four. The 13-year veteran had allowed only one home run in 25 innings over his first four starts for the Brewers, who signed him to a three-year, $33 million contract as a free agent on March 25.

NOTES: Kershaw threw 117 pitches. The other leadoff homers Lohse has given up were by Jose Valentin (2001), Chuck Knoblauch (2002) and Jayson Werth (2011). ... Merck, Pfizer to jointly develop diabetes drug

(Reuters) - Pfizer Inc and Merck & Co Inc said they will co-develop Pfizer's experimental type 2 diabetes drug ertugliflozin, both as a standalone product and in combination with other drugs, including Merck's blockbuster Januvia.

The Pfizer medicine belongs to a new class of diabetes treatments called SGLT2 inhibitors. Now nearing Phase III late-stage trials, it is behind similar drugs in development -- including Johnson & Johnson's Invokana (canagliflozin) which was approved by U.S. regulators in late March.

Under their partnership, Merck and Pfizer will collaborate on development and marketing of ertugliflozin as well as on tablets that pair it with Januvia and the widely used oral treatment metformin.

Januvia is the leading member of another class of diabetes drugs called DPP-4 inhibitors. It is also sold in combination with another type of drug called metformin, under the brand name Janumet. The Januvia/Janumet tablets have annual sales of $5.75 billion, making them Merck's biggest products.

Richard Purkiss, an analyst with Atlantic Equities, said little is yet known about the Pfizer drug, but he said both companies stand to gain by developing it together.

"If you add Pfizer's drug to Januvia -- Merck's leading DPP4-inhibitor -- that would extend the Januvia franchise even further and help Merck," Purkiss said.

"And the beauty of this from Pfizer's perspective is they will be piggybacking on Merck's (Januvia) franchise and are also getting a contribution from Merck for the Phase 3 program," Purkiss said.

Pfizer has so far received $60 million in upfront and milestone payments from Merck under the ertugliflozin partnership and will be eligible for additional payments associated with clinical, regulatory and commercial milestones.

Merck and Pfizer will share potential revenue and certain costs on a 60/40 percent basis, the U.S. companies said.

Merck will continue to retain the rights to its existing portfolio of Januvia-containing products.

Purkiss said it was too early to speculate on potential sales of ertugliflozin, and whether it has blockbuster potential, because analysts have not yet seen clinical data from its trials.

Shares of Merck were up 0.36 percent, while Pfizer's rose 1.5 percent, both in afternoon trading on the New York Stock Exchange, amid a 1 percent gain for the ARCA Pharmaceutical Index of large U.S. and European drugmakers.

Boston bomb suspect in small cell with steel door

AYER, Mass. (AP) ? The Boston Marathon bombing suspect is being held in a small cell with a steel door at a federal medical detention center about 40 miles outside the city, a federal official said Saturday.

Federal Medical Center Devens spokesman John Collauti described the conditions under which 19-year-old Dzhokhar Tsarnaev was being held in the Ayer facility after being moved there from a hospital Friday.

Tsarnaev was injured during a police chase Thursday in which his brother, also a suspect in the bombing, was fatally wounded.

Collauti said in a telephone interview that Tsarnaev is in secure housing where authorities can monitor him. His cell has a solid steel door with an observation window and a slot for passing food and medication.

Collauti wouldn't discuss specific details related to Tsarnaev, but said that typically medical workers making rounds each shift monitor the inmates. He said guards also keep an eye on some cells with video cameras.

Also, inmates in the more restrictive section do not have access to TVs or radios, but can read books and other materials, he said.

"Really this type of facility is fully capable of handling him and it's not that much of an inconvenience because it's more or less business as usual," Collauti said.

Tsarnaev's mother said the bombing allegations against her son are lies.

Fertilizers provide mixed benefits to soil in 50-year study

Apr. 29, 2013 ? Fertilizing with inorganic nitrogen and phosphorus definitely improves crop yields, but does it also improve the soil?

The latest study to tackle this question has yielded mixed results. While 50 years of inorganic fertilization did increase soil organic carbon stocks in a long-term experiment in western Kansas, the practice seemingly failed to enhance soil aggregate stability -- a key indicator of soil structural quality that helps dictate how water moves through soil and soil's resistance to erosion.

The results of the research, which was carried out in continuous corn that was also irrigated and conventionally tilled, were somewhat surprising to lead author Humberto Blanco, a University of Nebraska-Lincoln soil physicist. The findings appear in the May-June issue of the Journal of Environmental Quality.

Fertilization typically leaves behind more crop residues in fields, he explains, which in turn can boost soil organic carbon levels. But unexpectedly in this case, "we didn't see improvement in soil aggregate stability even though soil organic carbon concentration increased," Blanco says, noting that soil particles usually bind together more strongly in aggregates as soil organic carbon concentrations rise.

He cautions, however, that more research is needed over a wider range of management and climatic conditions, particularly since studies of fertilizers' impacts on soil structural properties, such as aggregate stability, are currently few.

"Definitely the effects of inorganic fertilizer application on soil properties will depend on tillage and cropping systems," Blanco says. "So we need to look at this in other long-term experiments."

In the present study, he and co-author Alan Schlegel studied a randomized and replicated experiment that was set up in 1961 at Kansas State University's Southwest Research-Extension Center in Tribune. The experimental plots of irrigated and tilled (disk/chisel) continuous corn have received six different rates of ammonium nitrate fertilizer (range 0 to 200 pounds/acre) for 50 years. The plots also received two rates of triple superphosphate fertilizer (0 and 18 pounds/acre) for 50 years, and a higher phosphorus rate (36 lb/acre) for 19 years.

Growing corn continuously under conventional tillage and with high inputs of water and fertilizer may seem outmoded, but this management system is "not uncommon," as demand for corn grain and crop residues grow, Blanco says.

When he tested soils from the experimental plots, he saw soil organic carbon concentrations rise gradually with increases in nitrogen fertilization at soil depths from 0 to 6 inches, although not at deeper ones. Similarly, phosphorus fertilization increased soil organic carbon at depths of 0 to 3 inches and 6 to 12 inches.

But Blanco observed a different trend in soil aggregate stability, especially when nitrogen and phosphorus were applied together at high rates. At a depth of three to 12 inches, for example, adding more than 80 pounds of nitrogen per acre reduced the number of stable soil aggregates by 1.5 times when no phosphorus was applied, by 2.1 times at 18 pounds of phosphorus/acre, and by 2.5 times at 36 pounds of phosphorus/acre.

Blanco can't say for certain why this occurred, but he has some hypotheses. Some studies suggest that adding fertilizers rich in ammonium ions may cause soil particles to disperse rather than aggregate, thereby offsetting any positive effects of increased soil organic carbon content. Because tillage periodically disturbs the soil, it may also negate any benefits of fertilization.

Blanco is now testing these hypotheses in three additional long-term experiments in Nebraska that encompass a wider range of tillage practices and cropping systems. The effects of nitrogen and phosphorus fertilizers on crop yields are well-researched, of course. Likewise, reduced tillage, cover crops, intensified cropping systems, and other conservation practices are known to build the soil long-term. Blanco now wants to see the two come together.

"It's clear that we need inorganic fertilizers to meet the increasing demands for food production, so it's important to look at how the extensive use of inorganic fertilizers affects soil properties in the long term," he says. "The hypothesis is that inorganic fertilization combined with conservation tillage -- strip till, no-till, and others -- may improve soil structural properties relative to conventional tillage systems."

Steve Blank: Zhongguancun in Beijing: China's Silicon Valley

I just spent a few weeks in Japan and China on a book tour for the Japanese and Chinese versions of The Startup Owner's Manual. In these series of five posts, I thought I'd share what I learned in China. All the usual caveats apply. I was only in China for a week so this a cursory view. Thanks to Kai-Fu Lee of Innovation Works, David Lin of Microsoft Accelerator, Frank Hawke of the Stanford Center in Beijing, and my publisher China Machine Press.

The previous post described the evolution of the Chinese Venture Capital system. The next two posts are about what I saw and learned in my short stay exploring Beijing's entrepreneurial ecosystem.

Entrepreneurship in Beijing
In the few days I was in China I met with several VCs, angel investors, business press and spoke to hundreds of entrepreneurs. I was blown away by what I saw in Beijing. First, I was amazed by the physical impact of the city itself. This was a modern city in a hurry to make a first impression -- think of what Rome looked like in the time of the empire or New York in the 1920s -- now it's Beijing announcing that China has arrived.

However if you scratch the surface, you can still find a bit of the old Beijing in the hutongs. Drive 50 miles outside the city into the surrounding villages and you see the distance China has to travel to bring the rural areas into the 21st century. In Beijing we hadn't seen air so badly polluted since we had been in Agra in India in the winter where I swear there was a day you could wave your hand in front of you and see traces of it in the air (and their excuse was they burn dung for heat.)

David Lin and the Microsoft China Accelerator were gracious enough to host two wonderful days of events for me. I trained the Startup Weekend Next Beijing mentors and instructors, presented to several hundred entrepreneurs, and had a great fireside chat with Zhen Fund founding partner Xu Xiaoping in front of another roomful of entrepreneurs.

Kai-fu Lee of Innovation Works was equally generous with his time. We had a fireside chat with a room full of eager entrepreneurs. And he was generous in sharing his insights about the current state of entrepreneurship and investment in China. And through it all Louis Yuan my patient and wonderful publisher from China Machine Press kept me moving through the events.

But what made the overwhelming impression for me was finding an entrepreneurial software cluster on par with the Internet software portion of Silicon Valley. The physical heart of the Beijing startups is in Zhongguancun in the Haidian District, located in the northwest side of Beijing. Startups here are primarily in what they call the TMT (Technology, Media and Telecommunications) segment. Not only does Zhongguancun have Chinese startups, but global technology companies (Nokia, Ericsson, Motorola, Sony Ericsson, Microsoft, IBM, Sun, Oracle, BEA, Alcatel Lucent, Google) all have offices here or elsewhere in Beijing.

If there ever was any question about the value of China's Torch Program walk around Zhongguancun. It was the first of the 54 Science and Technology Industrial Parks.

China Venture Capital
An entrepreneurial ecosystem is driven one of two ways; either by a crisis (i.e. innovation in the U.S. during World War II,) or during peacetime by profit.

If it's driven by profit then the ecosystem needs both entrepreneurs as well as Venture Finance.
China now has plenty of both.

China has the biggest venture capital industry outside the U.S. To compare the two, in 2011 U.S. venture capitalists invested $26.5 billion in all deals. Out of that total, they funded 967 Internet deals with $6.7 billion.

By comparison, in 2011 Chinese VCs invested $13 billion in all deals. Out of that total, they funded 268 Internet deals with $3.2 billion. About one-third of all China's venture capital investment is made in Beijing and the majority of those investments are in the Technology, Media and Telecommunications (TMT) sector I'll describe shortly.

As vibrant as the China venture business has been, 2012 was a different story. VCs pulled back and only invested $3.7 billion in all deals, funding just only 43 deals with $563 million.

Closed for You, Open For Us
First a bit of context in what the VCs in Beijing are investing in. China has essentially closed its internal search, media and social network software market to foreign companies who wouldn't play with the government rules on the Great Firewall (China blocks "objectionable" website content and monitors everyone's Internet access.)

Google retreated to Hong Kong and Baidu took its place. Facebook was too frightening to Chinese censors, so Renren is the leading social media player. Email? Working professionals/white collar use emails, but most users grew up instant messaging on TenCent's QQ and most are moving to Weixin/WeChat. Twitter? No, it's Sina Weibo, and if you want games with your chat -- TenCent. Amazon and eBay? Nope in China it's Alibaba's Taobao or 360buy.com. If you're outside of China, you never hear about these companies or interact with them because they're geared to serve only Chinese users.

This closed but very large market means that greater than 90% of Chinese software startups focus exclusively on the Chinese market. (The

This has resulted in a completely different consumer software ecosystem than found elsewhere in the world. Given the closed market to U.S. Internet companies, VCs in China have guided startups to execute the "copy to China" model. Thinking, if it worked in the U.S., copying a known model is less risky than trying something new and untested. The problem is that this space is getting really crowded -- from the bottom up as everyone tries the 200th clone -- and from the top down, as the major incumbents try to fill every possible market niche.

The table below maps the type of software in China to their global equivalents in each product category in the Technology, Media and Telecommunications (TMT) sector.

A Huge Market Is Finally Real
For a hundred years the fantasy of global marketers was, " if only everyone in China would buy one..." That day is final here. The numbers of mobile subscribers are staggering -- 1.18 billon, 260 million are 3G. Chinese Internet companies live in a large closed, self-contained ecosystem with 564 million web users with 420 million having mobile web access. 309 million use microblogs and 242 million shop online. (BTW, market research, financial and other statistical information are usually unreliable in China, but even taken with a grain of salt these are staggering numbers.)

Investment in the Technology, Media and Telecommunications (TMT) sector
The charts below from David Lin, Microsoft Accelerator detail investments in the Technology, Media and Telecommunications (TMT) sector -- almost all of it is centered in Beijing. (Note that these numbers differ from the Zhen Fund data -- welcome to statistics in China -- but they both provide an overall sense of the market size and direction.)

45% of all Venture Capital Investment in China went into the Technology, Media and Telecommunications (TMT) sector.

The number of deals in Technology, Media and Telecommunications more than doubled in 2011 over the previous five years and slowed back down dramatically in 2012. More than 1,600 VC investments in TMT have been made since 2007, with a record high of 436 in 2011.

Internet investments makes up more than 50% of all the deals in Technology, Media and Telecommunications made since 2011, while, e-commerce investments, in turn, accounts for nearly 50% of the investment deals in Internet. Investments in Mobile Internet makes up roughly 11% of all the deals in Technology, Media and Telecommunications, and have been on the rise since 2011.

Series-A round investments dominates Technology, Media and Telecommunications (TMT) deals, making up 60% of all.

Beijing, Guangdong (including Shenzhen) and Shanghai came out as the most dynamic spots for Technology, Media and Telecommunications (TMT) investments.

Beijing Venture/Angel Ecosystem
While Beijing has VCs and Angel investors happy to write a check there aren't as many angels/VCs in China versus U.S. per capita. Several VCs mentioned that there's a funding gap for seed stage investments. The Angel/Seed network in Beijing feels fragmented and mostly inexperienced (as are a good number of the China VCs). Kind of reminded me of the drivers in Beijing -- they were all driving in a way that made me think they all just got their drivers license -- until I remembered that they did. Car sales in China went from 1 million in 2001 to 14 million in 2011.

Other Beijing ecosystem issues I heard about were the things we take for granted: the lack of knowledge sharing ("pay it forward" isn't part of the culture,) limited mentoring (few experienced mentors,) and a lack of open source education, and no AngelList model. In the U.S. it's easy to share and browse ideas and deals, but in China there's a long legacy of guarding knowledge as power, and the justifiable paranoia of someone copying your idea prevents sharing.

Liquidity
Unlike the U.S. there are almost no mergers or acquisitions in this market segment. It's much easier to just steal their ideas and hire their employees. So big companies rarely acquire startups. Liquidity for most Internet startups happens via IPO's. 70% of exits in China are via IPO (in the U.S. on NASDAQ or the NYSE or on ChiNext, China's equivalent of NASDAQ) compared to the 90% of exits in U.S. via mergers or acquisitions. Alibaba (commerce), Tencent (games/chat) and Baidu (search) all have market caps over $40 billion.

Based on last quarter's global PC shipment numbers, Microsoft continues to feel pain in making the case for Windows is a viable tablet operating system. Theoretically, the dual-identity (Windows 8/RT) operating system has everything it needs to be a contender, but the promise is ahead of the reality on three interdependent fronts: chip-level hardware, legacy support, and app software.

For example, if x86 chips were more competitive with ARM processors from a performance-per-watt perspective, then Microsoft wouldn't be as reliant on Metro-style apps for functionality. And if more developers were creating Metro-style apps, then consumers wouldn't have to go to the legacy desktop mode as much to get things done. (Until the company releases a Metro-style Office, Microsoft really can't wag its finger too much at third parties.)

BEIRUT (AP) ? Syrian opposition forces have targeted government officials, army and police officers and civil servants in their campaign to topple President Bashar Assad's regime.

Here is a list of some of the major assassination attempts in Syria since the uprising against Assad began in March 2011:

?April 29, 2013: A bomb attached to a parked car detonates as Prime Minister Wael al-Halqi's car drove by. Syrian state media reported the prime minister was not hurt in the bombing in the upscale Damascus neighborhood of Mazzeh, which is home to many embassies and officials in Assad's regime.

?March 21, 2013: A suicide bomber blows himself up in a mosque in central Damascus, killing Sheik Mohammad Said Ramadan al-Buti, a leading Sunni Muslim preacher and outspoken supporter of Assad, and 41 others.

?Dec. 12, 2012: A car bomb targets the Interior Ministry in Damascus, wounding Interior Minister Mohammed al-Shaar. Initially, Syrian state media said al-Shaar was not hurt in the blast, but "several" were killed. News of his injuries emerged a week later, after he was brought to neighboring Lebanon for treatment.

Plants moderate climate warming

Apr. 28, 2013 ? As temperatures warm, plants release gases that help form clouds and cool the atmosphere, according to research from IIASA and the University of Helsinki.

The new study, published in Nature Geoscience, identified a negative feedback loop in which higher temperatures lead to an increase in concentrations of natural aerosols that have a cooling effect on the atmosphere.

"Plants, by reacting to changes in temperature, also moderate these changes," says IIASA and University of Helsinki researcher Pauli Paasonen, who led the study.

Scientists had known that some aerosols -- particles that float in the atmosphere -- cool the climate as they reflect sunlight and form cloud droplets, which reflect sunlight efficiently. Aerosol particles come from many sources, including human emissions. But the effect of so-called biogenic aerosol -- particulate matter that originates from plants -- had been less well understood. Plants release gases that, after atmospheric oxidation, tend to stick to aerosol particles, growing them into the larger-sized particles that reflect sunlight and also serve as the basis for cloud droplets. The new study showed that as temperatures warm and plants consequently release more of these gases, the concentrations of particles active in cloud formation increase.

"Everyone knows the scent of the forest," says Ari Asmi, University of Helsinki researcher who also worked on the study. "That scent is made up of these gases." While previous research had predicted the feedback effect, until now nobody had been able to prove its existence except for case studies limited to single sites and short time periods. The new study showed that the effect occurs over the long-term in continental size scales.

The effect of enhanced plant gas emissions on climate is small on a global scale -- only countering approximately 1 percent of climate warming, the study suggested. "This does not save us from climate warming," says Paasonen. However, he says, "Aerosol effects on climate are one of the main uncertainties in climate models. Understanding this mechanism could help us reduce those uncertainties and make the models better."

The study also showed that the effect was much larger on a regional scale, counteracting possibly up to 30% of warming in more rural, forested areas where anthropogenic emissions of aerosols were much lower in comparison to the natural aerosols. That means that especially in places like Finland, Siberia, and Canada this feedback loop may reduce warming substantially.

The researchers collected data at 11 different sites around the world, measuring the concentrations of aerosol particles in the atmosphere, along with the concentrations of plant gases, the temperature, and reanalysis estimates for the height of the boundary layer, which turned out to be a key variable. The boundary layer refers to the layer of air closest to the Earth, in which gases and particles mix effectively. The height of that layer changes with weather. Paasonen says, "One of the reasons that this phenomenon was not discovered earlier was because these estimates for boundary layer height are very difficult to do. Only recently have the reanalysis estimates been improved to where they can be taken as representative of reality."

OpenMobile ACL for webOS resurrected on Kickstarter, hopes to bring Android apps to HP Touchpad

The promise of OpenMobile's Application Compatibility Layer is inciting: seamlessly run Android apps on another operating system as if it was meant to be there. Unfortunately for fans of Palm's last hurrah, the project's webOS port died with the HP Touchpad. That won't stop dedicated fans, however -- Phoenix International Communications plans to resurrect webOS ACL. Taking the project to Kickstarter, the team has showed an early build of the project on an HP Touchpad, seamlessly running Android apps in cards alongside native webOS applications. Phoenix hopes that a functional ACL will reduce Touchpad owner's reliance on dual-booting Android, giving them the freedom to enjoy webOS without sacrificing functionality. The team is promising a relatively short development time, thanks to OpenMobile's early work, and hopes to deliver a consumer ready build in July. Carfax's catchy ads have encouraged millions of Americans to say "Show me the Carfax!" when purchasing used cars. That's great for Carfax's bottom line, but not so much for the dealers who have to provide those brand-name reports -- to the tune of $16.95 a pop, or a monthly subscription of up to $1,549.
