Cybercrime disclosures rare despite new SEC rule

(AP) ? Hackers broke into computers at hotel giant Wyndham Worldwide Corp. three times in two years and stole credit card information belonging to hundreds of thousands of customers. Wyndham didn't report the break-in in corporate filings even though the Securities and Exchange Commission wants companies to inform investors of cybercrimes.

Amid whispers of sensational online break-ins resulting in millions of dollars in losses, it remains remarkably difficult to identify corporate victims of cybercrimes. Companies are afraid that going public would damage their reputations, sink stock prices or spark lawsuits.

The chairman of the Senate Commerce, Science and Transportation Committee, Sen. Jay Rockefeller, D-W.Va., is adding a provision to cybersecurity legislation that would strengthen the reporting requirement. The SEC's cybersecurity guidance issued in October is not mandatory. It was intended to update for the digital age a requirement that companies report "material risks" that investors want to know.

Rockefeller's measure would direct the SEC's five commissioners to make clear when companies must disclose cyber breaches and spell out steps they are taking to protect their computer networks from electronic intrusions.

"It's crucial that companies are disclosing to investors how cybersecurity risks affect their bottom lines, and what they are doing to address those risks," Rockefeller said Friday.

The SEC recently challenged Internet retailer Amazon's decision to omit from its 2011 annual report references to the online theft of customer data held by Zappos, an online shoe company owned by Amazon. Amazon eventually agreed to modify the statement slightly, according to correspondence between the company and the SEC. But the company still argued that the Zappos attack was not covered by the commission's cybersecurity guidance because it had no material impact on Amazon's business.

Cybercrime is rampant and not confined to the United States. The head of Britain's domestic spy agency said this week that cybersecurity ranks alongside terrorism as one of the United Kingdom's most pressing security challenges. In one recent case, an unspecified, London-listed company hit by a cyberattack incurred revenue losses of $1.2 billion, MI5 Director General Jonathan Evans said in rare public remarks in London. He did not identify the company or say which country was behind the attack. The U.S. has said China and Russia are the governments most frequently engaged in such hacking.

"What is at stake is not just our government secrets but also the safety and security of our infrastructure, the intellectual property that underpins our future prosperity, and the commercially sensitive information that is the lifeblood of our companies and corporations," Evans said.

Research by a cybersecurity expert shows dozens of Fortune 500 companies have lost a wide range of valuable information to cybercrimes, including intellectual property, bank account credentials, restricted data about patients of pharmaceutical companies and internal legal records.

Rodney Joffe of Neustar, an Internet infrastructure management company in Virginia, monitors networks used by online criminal groups and traces the origin of stolen information. He found evidence that 162 out 168 companies in the manufacturing, chemical and transportation sectors had been compromised. The names of the companies are being kept confidential for proprietary reasons, he said.

"No one is safe. Everyone is compromised," said Joffe, Neustar's senior technologist. "When people tell you, 'We are protected as a company,' they are really fooling themselves."

The SEC isn't tracking how many companies comply with its cybersecurity guidance. But publicly traded companies historically have resisted supplying information about cyber incidents because it highlights their weak spots, said Peter Toren, a former federal prosecutor with the Justice Department's computer crime division.

"It just doesn't look good," Toren said.

The breach of Wyndham's computers was described in a Federal Trade Commission lawsuit filed this week against the company and three subsidiaries for alleged security failures that led to the three data breaches between April 2008 and January 2010. The failures caused "the export of hundreds of thousands of consumers' payment card account information to an Internet domain address registered in Russia" and millions of dollars in fraudulent charges on consumers' accounts, the FTC said.

Wyndham didn't mention the break-ins in its 2011 annual report or prior securities filings, according to an Associated Press review of the records.

Wyndham's 2011 annual report said the "hospitality industry is under increasing attack by cyber-criminals in the U.S. and other jurisdictions in which we operate" and noted that it was involved in "claims relating to information security and data privacy." Wyndham spent $13 million more on security improvements and expects to spend as much as $100 million in 2012 to guard against "the increasingly aggressive global threat from cyber-criminals," according to the report.

Wyndham said in an emailed statement to The Associated Press that it "fully complied with SEC regulations in regards to the disclosure of material events." In the statement, Wyndham said the incidents were "previously reported," an apparent reference to notices to consumers that were published on the company's website. The company also said the FTC's claims were without merit.

Network infrastructure company Verisign reported in late October, just a few weeks after the SEC issued the guidance, that there had been several successful cyberattacks against its corporate networks in 2010. In the filing, Verisign said the company's management had not been informed of the attacks until September 2011.

LinkedIn, the online networking service, publicly announced on June 12 the online theft of 6.5 million user passwords. It said the announcement complies with its obligations to the SEC, but it has yet to file a report about the incident with the commission.

The new SEC guidance puts pressure on companies to decide whether to disclose a breach or keep it secret, said Jody Westby of Global Cyber Risk, a consulting firm. But she said the demand for information amounts to locking the door after the house has been robbed.

"The SEC would have done better to require all public companies to say whether they've taken actions to implement a security program," Westby said.

Balotelli muscles Italy into Euro 2012 final

WARSAW, Poland (AP) -Mario Balotelli flexed his muscles in more ways than one.

The 21-year-old Italy striker quieted his multitude of critics by delivering Italy to an unexpected spot in the European Championship final. Having been severely criticized for failing to take advantage of his opportunities earlier in the tournament, Balotelli scored twice in the first half Thursday to give Italy a 2-1 win over Germany.

After his second goal, Balotelli stripped off his jersey and flexed his muscles in a defiant pose - even if that meant an automatic yellow card. For someone whose behavior often treads on the verge of craziness, it was an emblematic moment.

"This is the greatest night of my life, but I hope Sunday is going to be even better," Balotelli said, looking ahead to the final against defending champion Spain. "In the opening matches I had a lot of chances, and I wasn't able to finish them. But In football you also need luck."

In the 20th minute, Balotelli had no trouble getting past Holger Badstuber to head in a pinpoint cross from Antonio Cassano. Then in the 36th, he received the ball behind the defense and blasted a long shot into the top right corner.

With three goals, Balotelli moved level with four other players for the tournament scoring lead. After the match, Italy coach Cesare Prandelli was asked if this was the best match of Balotelli's career.

"Balotelli's career has just started," Prandelli said.

Meanwhile, Germany extended its winless streak against Italy in major tournaments to eight matches. The Germans failed to trouble Italy for much of the match, although Mesut Oezil scored a consolation penalty in injury time after Federico Balzaretti was whistled for a handball.

Germany had entered the game on a world record 15-match winning streak in competitive matches.

"It's a very bitter defeat," Germany captain Philipp Lahm said. "We tried everything in the second half but our goal came too late. We have so much potential in our team but if we cannot give the right performance at the right time or are not clever enough, then we lose such a game."

The final in Kiev, Ukraine, will be a rematch of Italy and Spain's 1-1 draw that opened Group C.

"We showed we're on Spain's level and that's where we started this run," Italy midfielder Claudio Marchisio said. "It's no longer a question of fear. Now we've got to pull out everything we still have inside ourselves."

While Italy has won four World Cups, it's only European Championship title came in 1968. Like when they won the 1982 and 2006 World Cups, the Azzurri have managed to maintain their focus despite a match-fixing and betting scandal at home.

"All I can say is that when you talk about Italy, everyone needs to be careful," Prandelli said. "We played an extraordinary match. We displayed a model of fair play and attachment to this shirt."

On a pleasant evening at the National Stadium Warsaw, Cassano set up the opening goal by befuddling Germany defenders Mats Hummels and Jerome Boateng to lift the ball in Balotelli's direction.

The second goal began with a long vertical pass from Riccardo Montolivo, whose mother is German. Balotelli collected the pass with his back to the goal, controlled the ball with his chest and then sprinted forward and unleashed a blazing shot from the edge of the area as Germany goalkeeper Manuel Neuer again stood immobile.

"We did what we had thought would put them in trouble," Prandelli said. "We played centrally and looked for one-on-one opportunities with Cassano."

Even before scoring, Italy controlled the pace of the match, although Germany did have several chances from Hummels, Toni Kroos and Oezil.

In the 35th, Italy goalkeeper Gianluigi Buffon preserved the Azzurri lead by swatting away a long shot from Sami Khedira - and Balotelli doubled the lead a minute later.

To start the second half, Germany coach Joachim Loew brought on Miroslav Klose for Mario Gomez at center forward and replaced Lukas Podolski with Marco Reus on the wing.

With Germany appearing slightly more organized, Lahm had a great look at the goal in the 49th but shot way over the bar.

"If we had scored earlier, there could have been more for us," Loew said. "The disappointment is great. Nobody is speaking in the dressing room. The players are crying. ... But I am not going to question everything we've done. This team has great quality. It will continue to develop and learn."

Buffon made another impressive save in the 62nd, leaping to push a free kick from Reus off the bar.

While Italy largely sat back and protected its lead in the second half, the Azzurri did produce some dangerous counterattacks. Marchisio shot just wide in the 67th and 75th and substitute Antonio Di Natale missed another chance in the 82nd.

Di Natale came on in the 70th after Balotelli went down with a cramp to his left leg.

White-clad German fans greatly outnumbered Italian supporters, unveiling a huge banner before kickoff that featured a giant "G" for Germany. However, most of the stadium was filled with Polish fans who supported Italy.

They had plenty to cheer about.

"We're living a dream along with millions of Italians," Italy defender Giorgio Chiellini said. "We're going to enjoy this victory a little longer, then we'll think about Sunday, because we want to continue dreaming."

Affordable Care Act upheld ? Washington now ahead of most states | Insurance Commissioner Mike Kreidler

Insurance Commissioner Mike Kreidler expressed great relief with the U.S. Supreme Court?s decision upholding the Affordable Care Act and said Washington state is now well ahead of most states in reforming its health care system.

Many reforms are currently in place, but key benefits and programs take effect in 2014, including Washington?s new Health Exchange, federal subsidies to help 477,000 people afford health insurance, an expansion of Medicaid for 328,000 poor childless adults and the ban on insurance companies from denying people coverage if they?re sick.

?I?m very pleased the Supreme Court chose to uphold the Affordable Care Act,? said Kreidler. ?We?ve been busy for two years now implementing the reforms and have made great progress, but there?s a lot left to do before 2014. With the court decision out of the way, we can continue our focus on where it should be ? bringing relief to families struggling to find quality, affordable health insurance.?

The millions of Washington state consumers benefitting from the Affordable Care Act?s early reforms include:

  • More than 2.4 million people who no longer face lifetime caps on their health benefits.
  • More than 52,000 young adults up to age 26 who have stayed on their parents? health plans.
  • More than 1.2 million people who now have coverage for preventive care with no co-pays or deductibles.
  • More than 60,000 people in Medicare who have saved hundreds on their prescription drugs.

Washington state also leveraged millions in federal funds available under the Affordable Care Act to create:

?The Affordable Care Act is not perfect, but it moves us in the right direction and is the only meaningful reform that?s passed in decades,? said Kreidler. ?The debate was clearly contentious, and I?m grateful to have it behind us. Suu Kyi tells AFP willing to lead Myanmar if her party wins

Myanmar democracy champion Aung San Suu Kyi said Thursday that she is prepared to lead her country one day, speaking with AFP in Paris at the end of a triumphant Europe tour.

The Nobel Peace Prize laureate, in Europe for the first time in a quarter-century after enduring many years of house arrest, also spoke of her joy at the warm reception she received on her five-nation tour.

Asked whether she would be ready to lead the country also known as Burma one day, she said: "I think all party leaders have to prepare themselves for the possibility, if they truly believe in the democratic process.

"But it's not something that I think of all the time. In fact, I think one has to concentrate on present work, of course preparing for the future. The present has to be linked to one's hopes for the future."

Suu Kyi, 67, flies back on Friday to Myanmar, ending the tour during which she was cheered by large crowds of admirers and toasted by leaders in Switzerland, Norway, Ireland, Britain and France.

"So many people from different parts of the world seem to be aware of what we have been struggling for in Burma," she said. "I felt such a tremendous sense of solidarity with us. That has been a surprise."

Suu Kyi on Thursday had breakfast with French former president Nicolas Sarkozy and his wife Carla Bruni-Sarkozy, visited parliament and then held a debate with students at the Sorbonne university in Paris.

She admitted her two-week journey was strenuous and quipped: "It's very exhausting, and when people ask me about all the sacrifices that I've made, I'm always tempted to say the greatest sacrifice I have made is sleep."

Myanmar, once under iron-fisted military rule but now run by a quasi-civilian government, faces legislative elections in 2015, which Suu Kyi's National League for Democracy is set to contest.

But Suu Kyi stressed that the hard work needs to be done now.

"I think we can't wait until 2015 to see how things will emerge," she told AFP."It is now that is most important... the next three years will decide what shape 2015 will take."

As Western nations have eased or suspended sanctions, a business bonanza is under way in the resource-rich but impoverished nation.

Suu Kyi, the Oxford-educated daughter of the country's independence hero, stressed that "whether it's investment from China or the West, there should be codes of best practices to ensure that the investments are as beneficial for our people as profitable for the investors.

Suu Kyi said the key would be to strengthen the rule of law and citizenship laws, to ascertain which Rohingya are legal citizens and which are not.

"Some of them, I'm sure, are in accordance with the citizenship laws, entitled to the rights of citizens, but who these are we have to be able to find out," she said.

"Communal strife, lack of communal harmony, is usually rooted in cultural and religious differences which take time to sort out. But with rule of law, immediate problems could be minimised.

"The problem in the west is... that the border is very porous. And the immigration authorities are not always the least corrupt," she said.

"And so Bangladesh always says that people come over from Burma who belong to Burma, and Burma says that people are coming over from Bangladesh who do not belong here. So that's one problem.

"Another problem is the matter of citizenship. We need fair and strong citizenship laws which will stand up to international scrutiny."

On a lighter note, Suu Kyi -- wearing her trademark flowers in her hair -- had a complaint about the continent she has just toured.

"I have been given many, many flowers. Everywhere I go people give me flowers," she said.

"But there is one problem which I must let our friends in Europe know: the stems of European roses are very thick, and that makes it difficult for me to keep them in my hair. And I would appreciate if they would go in for smaller, daintier varieties."

(AP) ? Fighter jets thunder above the English countryside. Missiles stand ready. And Big Brother is watching like never before.

The London Olympics are no ordinary games. Not since World War II have Britain and the United States teamed up for such a massive security operation on British soil.

Hundreds of American intelligence, security and law enforcement officials are flying across the Atlantic for the games that begin July 27. Some will even be embedded with their British counterparts, sharing critical intelligence and troubleshooting potential risks. Dozens of Interpol officers will also be deployed.

The unique collaboration is rooted in common threats the partners have faced since the Sept. 11 terror attacks on the U.S. and Britain's own deadly suicide bombings in 2005.

Britain was America's closest ally in Afghanistan and Iraq, making it a prime target of Islamic terror groups. And dozens of recent terror plots, including the 2006 plot to blow up nearly a dozen trans-Atlantic airliners, have been hatched within Britain's sizeable Muslim population, more than 1 million of whom have ties to Pakistan.

Although other Olympics have taken place since 9/11 ? Salt Lake City, Athens, Turin, Beijing and Vancouver ? London poses a different breed of security challenge.

"I'm confident that there is more than adequate security here for these games," Louis Susman, the U.S. Ambassador to the U.K., told The Associated Press. "That said, we live in a tumultuous world, whether that be in New York or London."

Intelligence officials say there has been an expected increase in chatter among extremist groups but there are still no specific or credible threats to the London games. The terror level is labeled substantial, a notch below severe and what it has been for much of the past decade. A substantial threat level indicates that an attack is a strong possibility.

"There is a perception in some quarters that the terrorist threat to this country has evaporated," said Jonathan Evans, head of Britain's domestic spy agency of MI5. "Bin Laden is dead, al-Qaida's senior leadership in Pakistan is under serious pressure and there hasn't been a major terror attack here for seven years. (But) in back rooms and in cars and on the streets of this country, there is no shortage of individuals talking about wanting to mount terrorist attacks here."

The potential threats to the London games are broad and diverse ? a lone wolf attacker such as Norway's Anders Behring Breivik who confessed to killing 77 people; a possible non-Asian Muslim convert who could slip by security with a European passport; a coordinated strike like the Sept. 11 terror attacks or a debilitating cyber-attack.

Although al-Qaida has been weakened by targeted U.S. strikes, its affiliates in places like Somalia and Yemen have stepped up their activity and increased their capabilities. They've even been working on bombs that can go undetected in airport scans.

British security officials fear that dozens of nationals who went to train in Somalia and elsewhere could eventually return.

"Terrorist problems have a long tail," said Evans. "They very rarely just stop."

Up to 1 million visitors are expected for the games, putting added strain on border security agents at airports like London's Heathrow, which has been criticized for its long lines and lack of staff to screen those arriving from other countries.

On site, some 300,000 people are expected to flow into Olympic Park in east London each day during peak times.

One of the key functions for Interpol, the international police organization, will be to speed intelligence data sharing between countries so threats can be deterred. U.K. officials scan Interpol data 130 million times per year, Interpol Secretary General Ronald K. Noble told the AP during an exclusive interview at the agency's Lyon headquarters.

"The truth is, and we know this from Norway, that you can't identify one ethnic group and say that's the ethnic group that should only concern us," Noble said. "But this Olympics ? from all that I know and based on all the information that Interpol has ? should be a safe Olympics."

Shared intelligence, better technology and boosted resources have allowed security officials to crack organized plots before they happen but the possibility of a self-starter extremist who operates below the radar remains one of the biggest fears.

In the case of Breivik, there were few warning signals that the self-styled anti-Muslim fanatic was about to kill 77 people last summer. The same essentially was true for Mohamed Merah, a Frenchman of Algerian descent who in March killed three paratroopers, a rabbi and three Jewish school children in southwest France.

Security officials say unless people are already known to authorities, they can go virtually undetected as they plan atrocities.

The overall security numbers are staggering. The games will be protected by some 12,000 police officers during peak times and 23,700 security staff ? a number that includes some 13,500 troops on standby, which is more than the 9,500 British troops currently in Afghanistan. A no-fly zone will also be established over Olympic venues from July 14 to August 15.

More than 100,000 people have applied for jobs at Olympics venues, being vetted for employment history and possible criminal backgrounds. The more rigorous checks are done by the government for accreditation to get into the games, according to Ian Horseman Sewell with G4S, a global company providing most of the training and security staff for the Olympics.

Still, Sewell admits London is different than past games.

"London is a proven terrorist target and it is the first time the summer Olympics have been operated in a post 7/7 environment in a place that isn't a totalitarian state," Sewell said, referring to the 2005 suicide bombings in London and the 2008 Beijing games. "From a security perspective, London is breaking new ground."

G4S will also help secure venues outside of the park and protect athletes.

Some specific teams from places like Belarus, Belgium, New Zealand and Vietnam will be training in northern France to keep costs down ? a move that prompted a joint Franco-British security exercise earlier this year.

Protecting athletes has been a concern since a terror attack at the 1972 Olympics in Munich killed 11 Israeli athletes and coaches.

"Israeli athletes will be staying away from the others in a more secluded area and with more security," a senior Israeli intelligence official told the AP, speaking on condition of anonymity because of the sensitivity of his job. "But a repetition of what happened in Munich is considered unlikely because Israel is ready and also because it isn't the kind of attack Palestinians would want now."

Technology has also advanced from past games.

Special Israeli surveillance technology has been rolled out for the Olympics across Britain, a country already known for its 4 million closed-circuit television cameras. Even more cameras have been installed at the Olympic Park.

Advanced facial and image recognition software will be used to identify suspects and connect multiple crime scenes. Cameras will be used to capture suspicious behavior. And special drones will be used for crowd surveillance, according to a salesman at an Israeli company who spoke on condition of anonymity because he was not authorized to speak to the press.

And remember the movie "Speed" where a bomb would allegedly go off if a bus went slower than 50 mph (80 kph)? Hundreds of public transport vehicles and VIP buses being used in the London games have already been equipped so authorities can tell if a driver is acting erratically ? something that might happen in a hijacking.

Authorities will also be able to stop a vehicle remotely or keep it going at a certain speed ? technology that could be useful if a terrorist were carrying explosives and threatening to crash a bus full of athletes into a crowded venue.

The British military has already made headlines with the weapons it will have available ? surface-to-air missiles, RAF Typhoon combat aircraft and an aircraft carrier docked on the Thames, the river that cuts across London close to several Olympic sites.

Security officials had worried that Irish dissidents could target the games, but those fears have dissipated.

Despite the U.S.-U.K. collaboration, there will still be differences in how the London Olympics is policed. Most of the security personnel will be unarmed ? a striking difference to operations in the United States.

Adding to security issues, leaders from around the world will want to visit during the Olympics. The American delegation will be led by first lady Michelle Obama while President Barack Obama focuses on his re-election campaign.

"I've not heard any American who has said they were concerned about security here," said Susman, the ambassador. "London has made an effort to showcase London for the world and I think it's going to be terrific."

Obama offers storm assistance to Florida governor

(AP) ? President Barack Obama has assured Florida Gov. Rick Scott that his state will have "no unmet needs" as it responds to extreme weather and flooding from Tropical Storm Debby.

White House spokesman Jay Carney says Obama expressed his condolences for the loss of life, as well as the extensive storm damage. Carney says Obama told Scott the federal government would be in close contact with the state and stood ready to provide additional assistance if necessary.

Debby has socked Florida with high winds and heavy rain that has already led to flooding, with officials warning of more to come.

Obama called Scott from Air Force One as he flew to Atlanta for a campaign event. The president will be in Miami later Tuesday to attend two campaign fundraisers.
